TEORÍA CONSTITUCIONAL
El sistema de pesos y contrapesos es utilizado por primera vez en la Constitución de Estados Unidos de América, a partir de esta, se sentó un precedente para las siguientes
constituciones como
las de América latina y
Francia. Sin lugar a
dudas, la constitución
de EE.UU fue pionera
en este sistema, el cual
se fundamenta en el
principio del equilibrio
de poderes, y donde
las tres ramas,
ejecutiva, legislativa y
judicial, comparten el
poder. Cada una tiene
estipulada unas
funciones, pero al igual
tiene el deber de
controlar o frenar a las
otras dos respecto a la
extralimitación de
poder, creando un balance.
Respecto a la Constitución Estadounidense, podemos agregar que esta basada en un sistema de gobierno federalista, que grosso modo consiste en la interrelación entre los diferentes Estados y el gobierno federal. La gorma de gobernar en los Estados Unidos y en base al federalismo esta diseñada para que el proceso de toma de decisión todos los niveles de gobierno y todas las ramas participen activamente, distribuyendo el poder de manera que estos trabajen separadamente pero con un fin común de trabajar como nación.
4. SYSTEM OF CHECKS AND BALANCES:

The system of checks and balances is used for the first time in the United States Constitution, and it established a precedent for the next constitutions
of the world, like the ones of
Latin America and France.
Without any doubts, the USA
constitution was the pioneer of
this system, which is based in
the balance of powers, and
where the three branches,
executive, legislative and judicial
share the power. Each one
has already their stipulated
functions, but likewise they
have to check the other two
so they create a balance.
Whereas the American
Constitution, we can add that
it’s based on a federal system,
which it basically consist in the
interrelationship between the
different states and the federal government. The United States governance is federalist and design in a way that the process of making decisions includes every level of government and the branches and invites them to participate actively, making it their final goal to work as a nation.
